The two brothers have jointly filed this petition. Petitioner No. 1 is a practicing lawyer of this Court and petitioner No. 2 is residing in the village. They are aggrieved by certain illegal actions of the respondent Nos. 5 and 6. Respondent No. 5 is said to be a political leader of the party in power.
The petitioners by means of this petition want that their F.I.R. be registered against respondent No.6 under Section 429 I.P.C. at P.S. Maudarwaja, District Farrukhabad and that petitioners be provided with police protection.
If an F.I.R. is not being registered by the police, the remedy of the petitioners is to approach the local court under Section 156 (3) of Cr.P.C.
The petitioners may apply to the District Magistrate/S.S.P. in accordance with the Government Orders dated 09.05.2014 and 01.01.2016 for providing security for their person and property.
In view of the aforesaid facts and circumstances, the petitioners for the redressal of both their grievances have alternative remedies by going before the local court under Section 156 (3) of Cr.P.C. and to the administrative authorities as per the Government Orders for seeking protection and security.
Nonetheless, since it is a matter allegedly involving a political person, we direct the S.S.P. also to look into the matter at his own end and on being satisfied, may help the petitioners in the lodging of the F.I.R. and in providing security.
