Heard Sri Pankaj Garg, learned Senior Advocate assisted by Sri Milind Garg, learned counsel for the petitioner and perused the records.
The present writ petition has been filed with the following relief:-
"a) Direct the Respondent No. 1 to 4 to comply the judgment dated 03.02.2021 passed by the Ld. Maintenance Tribunal cum Sub Divisional Magistrate, Dadri/Respondent No. 3 in Case No. 18338/2020 matter titled as 'Sudhir Katyal Vs. Aditya Katyal & Anr.' to the extent that the peaceful physical possession of one room in the subject property is handed over to the Petitioner by the Respondent No. 5 or 6 or both with peace and dignity Or in alternative direct the Respondent No. 3 to dispose of the Application of the Petitioner under Section 11 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 in an utmost time bound manner which is pending since 15.03.2021 so as to comply the judgment dated 03.02.2021 passed by the Respondent No. 3 so as to further ensure the safety of life and property of the Petitioner."
A perusal of the records indicates that the application moved by the petitioner herein under Maintenance and Welfare of Parents and Senior Citizens Act, 2007 had been rejected with the following observations:-
अतत पपरर/वपदद कप पपररनप-पत सदननयर ससनटजन एकट कक अनतररत पपषणदय न हपनक कक कपरण ननरसत नकयप जपतप हह। चचचनक पशनरत पकरण मम वहवपनहत नववपद कप पशन नननहत हह सजस कपरण उक पकरण मम मनहलप रपनप जनपद रगतमबबदनरर उपरपक पररससरनतयय कप दनषरत रखतक हहए उनचत कपनचनद कपयरवपहद करनप सबननसशचत कर। यपचद यनद चपहक तप सकम नयपयपलय मम वपद यपसजत कर अनबतपष पपप कर सकतप हह। पतपवलद बपद आवशयक कपयरवपहद दपसखल दफतर कक जपयक। It is categorically observed in the order passed by the Sub Divisional Magistrate that the issue being raised before him pertains to some matrimonial dispute for which the applicant can approach the competent court and get the relief being sought before the maintenance tribunal.
In the said circumstance, the prayer in the writ petition based on some findings returned by the Sub Divisional Magistrate in the order dated 03.02.2021 is found misconceived.
The writ petition is, accordingly, dismissed.
