JUDGMENT / ORDER

Petitioner is the accused in Crime No.1258/2013 of Kilimanoor Police Station, Thiruvananthapuram District. The offences alleged against him are punishable under Secs.498A and 306 of IPC. Apprehending arrest, this petition is filed for anticipatory bail.
2. The wife of the petitioner poisoned her children and she herself consumed poison on 14.11.2013. She and one child died in the hospital. She died on 20.11.2013, it is alleged. A report was filed alleging that the petitioner's wife committed suicide and the wife poisoned her children because of the cruel treatment meted out to her by the petitioner, who is her husband. It is stated that he used to come hot drunk and subject her to unbearable treatment. The statements of some of the B.A. No.3561 of 2014 -: 2 :-
witnesses recorded by the investigating officer would prima facie show that the allegation of cruelty mentioned therein is true. It is stated that the accused was having illicit connection with another woman and it was because of that he subjected his wife to such a cruelty and that he in fact wanted to avoid the victim woman.
3. It is vehemently argued by the learned counsel for the petitioner that the woman, who consumed poison (the wife of the petitioner) died after 4 or 5 days. But, she did not give any such statement to the police. That alone is not a reason to say that the materials collected by the investigating agency can be simply brushed aside. This is only an application for anticipatory bail. I do not find any reason to grant anticipatory bail to the petitioner.
It is hence, dismissed.
