Sri R.L. Verma, Advocate has filed his power on behalf of opposite party no.2, which is taken on record.
Heard counsel for the parties.
The victim Pinki Devi is present in Court along with her mother Smt. Hemwati. They are identified by both the counsels.
Learned counsel for the revisionist submits that the victim was already married to the revisionist Sudhir Kumar who was also present in the Court. The victim informs that her date of birth is 1999 and she is major. Counsel for the petitioner also relied upon the judgment in case of Suhani and another vs. State of U.P. and others, in which Supreme court has already held.
The revisionist Sudhir Kumar is also present in the Court and undertakes that he will look after Pinki Devi, both are as husband and wife and ensure with regard to her security.
In view thereof, the judgment and order dated 04.10.2018, passed by Chief Judicial Magistrate, District Pilibhit in Case Crime No.405 of 2018 (State vs. Sudheer and others), under Section 363, 504 I.P.C., P.s. Bilsanda, District Pilibhit is quashed.
Since Pinki Devi is adult and has voluntary entered into wedlock with the revisionist, therefore, she is permitted to lead her life as per her will along with her husband.
With the aforesaid, the revision is allowed.
