JUDGMENT / ORDER

The petitioner herein is the accused in S.T. 4120 of 2012 of the Judicial First Class Magistrate Court - I, Ottappalam. On summons, he made appearance through counsel, but remained absent later. In such a circumstance, the learned Magistrate issued warrant of arrest against him. Now he wants to surrender before the learned Magistrate, but he apprehends that he would be remanded to judicial custody. He seeks a direction from this Court to the learned Magistrate to consider his application for bail on the date of surrender itself. In fact, no such direction can be granted because he can very well surrender before the learned Magistrate and seek regular bail. I do not think that he will be mechanically remanded to judicial custody, when the offence is bailable. This is not a case where he was initially released on bail and later jumped bail. With confidence, he can approach the learned Magistrate and apply for bail. This Crl.M.C is accordingly closed. Sd/- P.UBAID JUDGE ma /True copy/ P.S to Judge
