JUDGMENT / ORDER

The wife, who is the respondent in H.M.O.P.No.19 of 2016 on the file of Family Court, Dindigul, launched by the husband seeking divorce on the ground of cruelty, seeks transfer of the same to the file of Sub-Court, Theni,Theni District, to be tried along with H.M.O.P.No.90 of 2016 filed by her before Sub-Court, Theni, Theni District, seeking restitution of conjugal rights.
2.Considering the fact that there is possibility of conflicting judgements if the two petitions are allowed to be tried by two different Courts, this Transfer Civil Miscellaneous Petition is allowed and the Petition in H.M.O.P.No.19 of 2016 is withdrawn from the file of Family Court, Dindigul, Dindigul District and transferred to the file of Sub-Court,Theni, Theni District to be tried along with H.M.O.P.No.90 of 2016,pending on its file. The Family Court, Dindigul, Dindigul District is directed to despatch the records to Sub-Court, Theni, Theni District within a period of two weeks from the date of receipt of copy of this order. Consequently, connected Miscellaneous Petition is closed. No costs.
