Civil Misc. Modification Application No.2 of 2018, dated 24 August 2018, supported by affidavit is taken up.
Heard Shri Prem Prakash Sharma for the applicant-petitioner and the learned Standing Counsel for the respondents.
This application has been filed for modification of the order of the Court dated 31 July 2018. The writ petition had been filed by the petitioner on the allegation that a vigilance enquiry was being carried on by the Superintendent of Police (Vigilance Establishment), Meerut against the petitioner on the same grounds on which departmental enquiry/disciplinary proceedings had already been concluded by the Principal Secretary, Housing and Urban Planning in which the petitioner had been exonerated.
Counsel for the petitioner submits that till date, no order has been passed by the Principal Secretary inspite of the order of the Court dated 31 July 2018 and, therefore, further proceedings of the vigilance enquiry may be stayed.
The question of staying the proceedings of the vigilance enquiry does not arise. If the Principal Secretary has not passed any orders, the petitioner may avail such remedies as may be available to him in law.
The application is misconceived. It is, accordingly, rejected.
