JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioner and the learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 1042 of 2009, under Sections 406, 420, 504 and 506 IPC, police station Hazratganj, district Lucknow.
We have gone through the FIR, which discloses commission of cognizable offence and, as such, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed.
However, considering the argument advanced by the learned counsel for the petitioner that the petitioner is a lady and no serous allegations have been levelled against her, rather the same have been levelled against her husband, we hereby provide that if she surrenders and moves application for bail, the same shall be considered and disposed of by the courts below expeditiously by giving her benefit of Section 437 Cr.P.C.
