1. Heard Sri Virendra Kumar Jaiswal, learned counsel for petitioner and Krisham Pahal, learned counsel for respondents.
2. This petition has been filed by petitioner seeking following reliefs: -
"i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 1 and 2 to decide the representation of the petitioner and to take legal action against the Principal of Saraswathi Institute of Medical Sciences, Anwarpur Pilkhuwa, District Hapur, respondent no.3 and other persons who are involved in spoiling the career of the petitioner forthwith.
ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.1 and 2 to declare the proper result of the petitioner forthwith after concluding to enquiry."
3. Petitioner's representation is against Principal of Saraswathi Institute of Medical Sciences, N.H.24 Anwarpur Pilkhuwa, District Hapur and other persons, who, according to him, are involved in spoiling his career. Thus, petitioner is making allegations basically against private individuals for which remedy lies to him under common law. Writ under Article 226 cannot be issued in matters where remedy lies under common law.
4. So far as second relief is concerned, petitioner is not disputing that the result has already been declared. Thus, question for further direction to declare proper result does not arise.
5. Writ petition is, accordingly, dismissed.
