Heard learned advocate for the applicants and it is submitted that on the basis of agreement of 11 months, the respondents-complainant was rented out a residential premises w.e.f. 1.1.2007 which was not renewed later on and Regular Civil Suit No. 482 of 2009 filed by the complainant in which application for injunction came to be rejected by the Court on 17.12.2011by learned 12th Additional Senior Civil Judge, Surat. Even later on the applicants apprehended illegal action on the part of respondent No.2 and applied to the police authority on 26.2.2012. The public advertisement and the complaint impugned is a counter blast to the efforts of the applicants to get peaceful possession of the residential premises and it is nothing but abuse of process of law.
Considering the above aspect, I am inclined to issue Notice returnable on 11.4.2012.
Meanwhile there shall be ad-interim relief in terms of para 7(B).
