1. It is mentioned on behalf of learned Advocate Mrs. V.D.Nanavati for the Appellants that in spite of the interim order of this court, the Respondents have not complied with it and proceeded further with the constructions and completed the same, which may adversely affect.
2. However, as there is a leave note of learned Advocate Shri I.H.Syed for the Respondent, the matter is adjourned to 21 st December, 2012 with a clear understanding that in case he Page 1 of 2 HC-NIC Page 1 of 2 Created On Thu Aug 24 02:13:36 IST 2017 C/CA/10238/2012 ORDER does not remain present or no arrangement is made on his behalf, the matter shall proceed further irrespective of any leave note or sick note.
3. The interim order, which has been granted earlier shall continue till then.
4. To be placed with Civil Application No.11572 of 2012 in First Appeal No. 2940 of 2012 with Civil Application No. 11573 of 2012, 11574 of 2012 and 10222 of 2012 in the aforesaid First Appeal i.e. First Appeal No. 2940 of 2012.
