The matter is taken up through video conferencing.
Shri Rakesh Kumar Verma, learned counsel appears for the petitioner.
Shri Ashish Agrawal, learned counsel appear for the respondents no. 2 and 3.
Petitioner by way of present petition seeks following relief:-
"i) Issue a writ order or direction in the nature of certiorari to quash the impugned notice dated 04.02.2021, issued by the Respondent No. 2 against the Petitioner;
ii) Issue a writ, order of direction in the nature of mandamus directing the Respondent No. 2 & 3 to accept the entire Balance Amount i.e. Rs. 5,31,068/- + interest in easy installment;
iii) Issue a writ, order of direction in the nature of mandamus directing the Respondent Authority to decide the representation of the Petitioner dated 21/22.01.2020."
Learned counsel for the petitioner instead of pursuing the relief sought in the present petition prays for withdrawal of petition with liberty to avail the remedy under Section 17 of The Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002.
Prayer is allowed.
Petition is dismissed as withdrawn with the said liberty.
