Court No. - 34
Case :- WRIT - A No. - 8639 of 2021 Petitioner :- Sudha Devi Respondent :- State of U.P. and Another Counsel for Petitioner :- Janmed Kumar Counsel for Respondent :- C.S.C.
Hon'ble Yashwant Varma,J.
Heard learned counsel for parties.
The claim of the petitioner, a married daughter for appointment on compassionate grounds, has come to be rejected with the respondents finding that no evidence of dependency on the deceased government servant could be established. Before this Court, it is contended that the petitioner was at the time of death, living with the father and looking after him. That, in the considered view of the Court, alone does not establish dependency. While a child may reside with aged parents to provide them aid and support, it does not necessarily lead to the conclusion that they are dependent upon them. Additionally it may be noted that although a married daughter can also seek consideration for appointment on compassionate grounds under the Rules, it is still incumbent upon such an applicant to establish and prove a situation of dependency. Since the petitioner here failed to prove the aforesaid, the order impugned merits no interference.
The petition is dismissed.
