The petitioners are three in number. They have instituted this writ proceeding for a direction upon the respondents for the payment of additional compensation at the rate of 64.70%.
The grievance of the petitioners is that their land has been acquired by the respondents for the Planned Industrial Development in District Gautam Buddh Nagar but no compensation has been paid in terms of Government Order dated 29.8.2014. A copy of the said Government Order is on the record as annexure-4 to the writ petition, which has been addressed to the Chief Executive Officer - the third respondent.
We have heard learned counsel for the petitioners, learned Standing Counsel and Sri Suresh Singh, learned Advocate appearing for the third respondent.
It is stated that for redressal of their grievance the petitioners have made a representation on 30.11.2018 before the third respondent but has failed to elicit any response.
Having due regard to the facts of the case, we are of the view that the ends of justice would be met by issuing a direction upon the third respondent to consider the grievance of the petitioners. Accordingly, we dispose of the writ petition with a direction upon the third respondent to consider the cause of the petitioners and pass appropriate order in accordance with law expeditiously, preferably within three months from the date of communication of this order.
Needless to say that we have not adverted to the issue raised in the writ petition on merits. The authority concerned shall pass the order independently and in accordance with law.
No order as to costs.
