Heard Sri Sarvajeet Singh, holding brief of Sri K.K. Rao, learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed seeking the direction to the Additional Chief Judicial Magistrate First, Gorakhpur for expeditious disposal of Case No.438 of 2019 under Section 12 of D.V. Act pending before him.
Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant.
In the facts and circumstances of the case the lower court concerned is directed to expedite and conclude the proceeding of the aforesaid case preferably within a period of six months from the date of the production of certified copy of this order without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
With the aforesaid observation, this application is disposed of finally.
