JUDGMENT / ORDER

1. Ms. Bhoomi Thakore, learned advocate for the petitioner has submitted that the respondent company is unable to discharge its financial obligation. In support of her said submission she referred to the details mentioned in the petition and submitted that the dues of the respondent company are to the tune of Rs.2,50,000/- and in response to the demand made by the petitioner company vide its communication dated 20.9.2010 and 12.2.2011 the respondent company had vide its reply dated 28.9.2010 and 24.2.2011 admitted its dues, however on the ground that the financial position of the company does not permit it to make payment, the respondent has not cleared the dues. She also submitted that the petitioner company issued statutory notice dated 6.9.2011 which is duly served at the registered office of respondent company on 8.9.2011 as per the certificate issued by postal authorities.
2. Considering the aforesaid submissions by learned advocate for the petitioner office is directed to issue notice to the respondent company returnable on 21.2.2012.
