After arguing at some length, Sri Kunal Ravi Singh, learned counsel for the petitioners, states that this petition may be dismissed as withdrawn with liberty to file a revision under Section 41(3) of U.P. Urban Planning and Development Act, 1973, before the State Government. He further prays that an appropriate direction may be issued to the State Government to decide the said revision within a stipulated period.
Sri Bhanu Bhushan Jauhari, learned counsel for the respondent no. 2 and Sri A.P. Paul learned brief holder for the State-respondent, have no objection to the aforesaid prayer.
Considering the aforesaid, the writ petition is dismissed on the ground of alternative remedy. It is further provided that in case the petitioners file a revision along with certified copy of this order before the respondent no. 1, the same shall be decided, strictly in accordance with law, within a period of three months from the date of filing of said revision along with certified copy of this order, after affording due opportunity of hearing to the parties concerned.
