This criminal revision has been preferred against impugned order dated 01.03.2019 passed by learned Principal Judge, Family Court, Maharajganj in Maintenance Case No.32 of 2019 (Kamini Mishra vs. Subodh Mishra), u/s 125 Cr.P.C., P.S.-Nichlaul, District-Maharajganj whereby Rs.8000/- per month to the wife- opposite party no.2 and Rs.4000/- per month to the minor son-opposite party no.2 have been provided as maintenance amount.
Heard learned counsel for the revisionist and learned A.G.A. and also perused the record.
Counsel for the revisionist has not been able to point out any such illegality or irregularity, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order which reflects judicial application of mind. Relevant issues have been framed, analyzed and discussed and findings have been recorded in that regard in the impugned order. Rs.8,000/- to the wife and Rs.4000/- to the minor son have been fixed as maintenance which cannot be said to be either disproportionately enlarge or excessive in the present days of high price rise. The income of the husband has also been taken into account and it has been recorded that the revisionist is having sufficient means to pay the maintenance amount. This court does not see any element of perversity in the impugned order and therefore feels disinclined to substitute the discretion exercised by the court below by its own. This court does not see any good ground to allow this revision.
Revision lacks merit and therefore stands dismissed.
