The present application under Section 482 Cr.P.C. has been filed by the applicants with the prayer to quash the Complaint Case No. 7938 of 2018 (Kirti Pandey and others Vs. Suboth Kumar Pandey and others), under Section 12 Domestic Violence Act, Police Station Barra, District - Kanpur Nagar pending in the court of Special Chief Judicial Magistrate, Kanpur Nagar. Further prayer has been made to stay the further proceedings of the aforesaid case.
Heard learned counsel for the applicants and the learned AGA appearing for the State.
It is submitted by the learned counsel for the applicants that applicants are ready to settle the dispute on the basis of compromise. Matter be referred to the Mediation and Conciliation Centre of District court concerned.
On the other hand, learned AGA opposed the prayer.
Having regard to the facts and circumstances of the case, after perusing the entire record and having considered the submissions made by the learned counsel for the parties, the application is disposed of with the direction to the applicants to move proper application before the court concerned within twenty days from today ventilating all the facts as has been raised in this application. If such application is moved, concerned Magistrate is hereby directed to refer the matter to Mediation and Conciliation Centre of District Court concerned after obtaining the consent of other side. Incharge Mediation Centre is also hereby directed to make every endeavour to conclude the mediation as early as possible.
With the above observations, the application stands disposed of.
