JUDGMENT / ORDER

Petitioner challenges Ext.P9 notice issued by the 2nd respondent calling upon the petitioner to surrender the passport immediately. Ext.P9 was preceded with Ext.P7 show cause notice wherein it was, inter alia, indicated that the petitioner did not furnish proper particulars regarding the criminal case pending against him. It is not in dispute that the petitioner is involved in a criminal case which, according to the learned counsel for the petitioner, is for a bailable offence. The matter, according to the petitioner, is almost settled between the parties, but orders are awaited from the learned Magistrate to indicate that the case had been settled between the parties. Whatever that might be, the show cause notice has now culminated in Ext.P9 order, which is again an appealable order. If the petitioner intends to challenge Ext.P9, the petitioner will have to prefer an appeal under Section 11 of the Passport Act. 2. In such circumstances, I do not think that this Court can W.P.C.No.15956 OF 2014 2 interfere with Ext.P9 at this stage. Admittedly, there was non-disclosure of the factual circumstances while the petitioner applied for the passport. Of course the petitioner can as well approach the learned Magistrate seeking early orders in the settlement process.
In the above circumstance, there is no basis for the above writ petition and accordingly, the same is dismissed.
