Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief -
"i. Issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to decide the application filed by the petitioner on 13.01.2014 under rule 109 of Consolidation of Holdings Rules 1954 to carry out the order dated 21.05.2009 in revenue record passed by Consolidation Officer, Varanasi in Case No.401/478 under Section 9-A(2) of Consolidation Holdings Act."
It has been submitted that the application under Rule 109 of the Consolidation of Holdings Rules filed in January 2014 has not been disposed of till date.
Under the circumstances, this writ petition is disposed of directing the Consolidation Officer, Varanasi to decide the pending application of the petitioner under Rule 109-A of the Consolidation of Holdings Rules, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
Needless to say that the respondent no.2 shall pass order on the application in accordance with the law, after hearing the concerned parties and without granting any unnecessary adjournment to any of them.
With the aforesaid directions, the writ petition is disposed of.
