The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 13.12.2011 passed in Second Appeal No. 1089 of 2011 (Subhash Vs. Ram Kumar and another).
After some argument a prayer has been made by the counsel for the applicant to dismiss the present application with a liberty to file an appropriate application under Order 39 Rule 2-A of the Code of Civil Procedure in the pending second appeal.
Prayer is allowed.
The application is dismissed as not pressed.
