This writ petition has been preferred against an interlocutory order passed by the Board of Revenue dated 10.1.2018 whereby the Board of Revenue has summoned the record. No other order has been challenged.
Learned counsel for the petitioner submits that the Board of Revenue has no jurisdiction to summon the records under Section 333 (1)(a) of the U.P. Zamindari Abolition and land Reforms Act, 1950.
I have heard learned counsel for petitioner and the learned Standing Counsel.
The Board of Revenue has passed an innocuous order. No interim order has been passed while summoning the record. I do not find it a fit case to interfere under Article 226 of the Constitution of India.
Accordingly, the writ petition is dismissed leaving it open to the petitioner to raise this issue before the Board of Revenue by moving appropriate application.
No order as to costs.
