The petitioner has filed this petition for a direction upon the respondent- University to accept the registration fee of the petitioner for B.Sc. Part III 2017-18 Examination and to issue admit card to the petitioner for appearance in the examination, which is scheduled from 16.03.2018.
Sri Rohit Pandey, who appears for the University, has submitted that since the petitioner is admittedly student of a college affiliated to the University, the candidature of the petitioner has to be sponsored by the college therefore unless the college espouses the cause of the petitioner, University cannot directly entertain the request or prayer of the petitioner because all relevant records are with the college and college alone can disclose whether the petitioner is entitled to appear in the examination.
Be that as it may, considering that the examinations are scheduled from 16.03.2018, this Court considers it appropriate to leave it open to the petitioner to represent his cause before the Principal of the college concerned (third respondent) with copy to the second respondent (Controller of Examination, Chhatrapati Sahuji Maharaj University, Kanpur). If any such representation is filed along with certified copy of this order as also relevant documents, the third respondent, after verifying the facts from the record as to whether the petitioner is entitled to appear in the examination, shall place the same before the University along with prayer of the petitioner so that the University is in a position to take appropriate decision on the same keeping in mind that the examinations are to commence from 16.03.2018.
It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner.
