ORDER:
This civil revision petition is filed against order, dated 23.04.2014, in I.A.No.870 of 2014 in I.A.No.240 of 2014 in I.A.No.3132 of 2012 in ASSR No.13013 of 2012, on the file of the learned II Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar.
At the hearing, the learned counsel for respondent No.1 stated that in pursuance of the order in this revision petition, physical delivery of possession was effected by the bailiff on 05.07.2014. Sri P.Raj Kumar, learned counsel for the petitioners, while disputing this submission of the learned counsel, however, stated that recording of delivery of possession has not been done so far by the lower Court.
In my opinion, it hardly makes any difference whether delivery has been recorded formally or not, once physical possession has been delivered by the bailiff. In this view of the matter, it is not necessary to adjudicate the civil revision petition on merits.
The civil revision petition is accordingly dismissed, however, without prejudice to the rights of the petitioners to pursue the applications filed in ASSR No.13013 of 2012 and also the said appeal.
As a sequel to dismissal of the civil revision petition, interim order, dated 08.07.2014, shall stand vacated and C.R.P.M.P.No.2805 of 2014 shall stand disposed of as infructuous.
