Vide order dated 10.07.2014, notice has been issued revisionist to engage another counsel due to the death of Sri A.N. Mulla, learned counsel for the revisionist. As per office report dated 20.08.2014, notice has been issued to revisionist to engage another counsel but the same has not been received back after service. Again on 21.08.2014, Court has directed to issue notice and as per office report dated 25.09.2014, notice again issued to revisionist but the same has not been received.
This Court on 26.09.2014 again directed to issue fresh notice, but as per office report dated 20.09.2018, fresh notice was issued to the revisionist but the same has not been received. A report of Chief Judicial Magistrate, Ghaziabad dated 30 September, 2014 has been received and in the said report, it is stated that due to insufficient address, notice could not be served.
Matter pertains to Section 7(1)/16A of Prevention of Food Adulteration Act and the revisionist are awarded punishment of six months along with fine of Rs. 1000/-.
I have heard learned A.G.A., perused the records and found no illegality in the judgment of Judicial Magistrate dated 17.01.1989 and judgment of Appellate Court, VI Additional Sessions Judge, Ghaziabad dated 15.02.1990.
Accordingly, the revision is dismissed.
