Heard learned counsel for the applicant and the learned AGA.
The present application u/s 482 Cr.P.C. has been filed with a prayer to direct the trial court to conclude the trial of Case No. 529/9 of 2018 (State Vs. Rajpal and others) arising out of Case Crime No. 373 of 2017, under Sections 147, 148, 149, 323, 324, 504, 506, 325 IPC, P.S. Kakrauli, District- Muzaffarnagar, pending in the court of Civil Judge (Junior Division), Court No. 1, Muzaffarnagar expeditiously within stipulated period.
Learned counsel for the applicant has submitted that applicant is the first informant in the present case and the charges in the said case have already been farmed on 27.3.2018, however, since then the trial has been pending and lingering-on, on one pretext or the other and has not yet been concluded.
In view of the above, the Civil Judge (Junior Division), Court No. 1, Muzaffarnagar is expected to make all endeavours to decide the aforesaid case expeditiously, preferably within a period of ten months from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the application u/s 482 Cr.P.C. is finally disposed of.
