1. The record of the petition shows that the notice was issued way back on 7.5.2012. The record further indicates that both the respondents have been served and as such the respondent No.1 is already represented by the office of the learned Government Pleader. Strangely, as no response was received even after the order of directing the respondents to file affidavit in reply, by order dated 25.7.2012, this Court passed the following order: "Though served no one appears on behalf of respondent no.2. This Court (Coram : Hon'ble Smt. Justice Abhilasha Kumari) by order dated 7.5.2012 was pleased to issue notice which has been served. By further order dated 5.7.2012 the respondents were directed to file Affidavitin Reply. Till date, though served, neither any SCA/6710/2012 2/2 ORDER appearance nor any affidavit is filed by respondent no.2. However, in the interest of justice, as a last chance, respondent no.2 is directed to file his reply latest by 14.8.2012. S.O. to 16.8.2012. If no reply is filed, respondent no.2 shall personally remain present before this Court. Ms. Asmita Patel, learned Assistant Government Pleader is requested to inform respondent no.2 by FAX. Copy of this order be made available to Ms. Patel for onward communication."
2. Ms. Asmita Patel, learned AGP states that the order has been sent by Fax to the office of respondent No.2 - District Development Officer, Valsad.
3. As a last chance and as a direction of this Court, respondent No.2 - District Development Officer, Valsad is directed to see that he is represented before this Court and file an affidavit. If no affidavit or appearance is filed before the next date, respondent No.2 - District Development Officer, Valsad shall personally remain present before this Court at 11:00 a.m. on 28.8.2012.
4. S.O. to 28.8.2012. Direct service is permitted today.
