The cause list has been revised. No one appears to press the appeal. Even otherwise, we find that the learned Single Judge has categorically recorded after mathematical calculation that the percentage of reservation would exceed in case the claim of the appellant is accepted. The same being in teeth of the law laid down by the Apex Cout and no one present on behalf of the appellant the appeal has to go by default. Mr. V.C. Dixit, learned Additional Chief Standing Counsel for the State is present.
The appeal is accordingly consigned to records.
