Heard learned counsel for the petitioner, Sri Ramanand Pandey, learned Additional Chief Standing Counsel appearing for the State- respondent, Sri H.R. Mishra, learned Senior Advocate, assisted by Sri Devang Singh Rathore representing the intervention and Sri Narendra Kumar Giri representing the respondent no. 5.
Against the provisional determination of constituency of the District Cooperative Bank Limited, Bijnor, published on 11 April 2018 (Annexure No. 2), the petitioner has already filed his objection on 17 April 2018 (Annexure No. 3). Today date is fixed for deciding his objection.
In view of above, present petition appears to be premature, inasmuch as, objections raised by the petitioner are still to be considered and a decision to be taken by the third respondent, Joint Commissioner and Joint Registrar/ Divisional Cooperative Election Officer, Moradabad Division, Moradabad.
In view of the above, we are not inclined to entertain this petition.
The writ petition is, accordingly, dismissed. It goes without saying that third respondent would consider the objection of the petitioner and take an appropriate decision, in accordance with law.
