Grievance of the petitioner is that he has been transferred on his own request vide order dated 13.12.2019, but he has not been relieved.
Learned Standing Counsel has obtained instructions, according to which petitioner's transfer was subject to passing of qualifying examination in accordance with the U.P. Lekhpal Service Rules, 2006 and his confirmation, whereas petitioner has neither passed such examination nor his services have been confirmed. Copy of the instructions has been furnished to the counsel for the petitioner.
It is stated that petitioner has passed eligibility exam but it is admitted that petitioner has not been confirmed so far.
In view of the clear stipulation in the transfer order itself as the petitioner has not been confirmed in service, no exception can by taken if the respondents are not relieving the petitioner.
Writ petition, accordingly, is consigned to records.
