Petitioner claims to have been engaged on contractual basis as Senior Treatment Supervisor and claims to have worked for three and a half year. Such engagement was continued till June, 2017. It is stated that petitioner had fallen sick and therefore could not work for some period, whereafter his engagement was discontinued. It is also stated that in terms of the appointment letter, the authorities were liable to consider claim of petitioner for renewal and unless the services of petitioner were found unsatisfactory, ordinarily such engagement was liable to be renewed. Reliance is placed upon judgment of this Court in Special Appeal No.792 of 2010, decided on 5.10.2010. Since petitioner's claim has not been considered for renewal, therefore, he has approached this Court.
Learned Standing Counsel submits that since petitioner's engagement come to an end in June, 2017, therefore, it is possible that somebody else may have been engaged by now.
Be that as it may, in such circumstances, it would be appropriate to dispose of this writ petition with a direction upon the respondent no.4 to consider petitioner's claim for renewal of his engagement in terms of his appointment letter, if his service were satisfactory and there exists vacancy against which petitioner could be considered. Such consideration would be made within a period of three months from the date of presentation of certified copy of this order.
With the aforesaid observations/directions, this writ petition stands disposed of.
