|

JUDGMENT / ORDER

Court No. - 29
Case :- WRIT - C No. - 28212 of 2018 Petitioner :- Subhash Chandra Respondent :- State Of U P And 2 Others Counsel for Petitioner :- Vinod Kumar Singh Parmar Counsel for Respondent :- C.S.C.
Hon'ble Pankaj Mithal,J. Hon'ble Shashi Kant,J.
Heard learned counsel for the petitioner.
Petitioner is a contractor. According to him, he has constructed two culverts and in respect thereof, payment has not been made to him.
A writ petition for the direction to make the payment is not the appropriate remedy. There is nothing on record which can show that the amount as claimed by the petitioner is an admitted amount. The petitioner may approach the appropriate authority as per the contract, i.e. the Arbitrator or the civil court for the necessary relief.
The writ petition is misconceived and is dismissed. Order Date :- 23.8.2018 Nirmal Sinha
