Heard learned counsel for the petitioners; learned Standing Counsel for the respondent no.1; Sri B.D. Pandey for the respondent no.2; and Sri Ashok Khare, learned Senior Counsel, assisted by Sri Vaibhav Prakash, for the respondent no.3.
The learned counsel for the parties do not dispute that against an order passed by the Vice-Chancellor, which is impugned in this petition, an alternative remedy of reference is available under Section 68 of the U.P. State Universities Act, 1973.
In view of the above, this petition is disposed of by leaving it open to the petitioner to avail the alternative remedy. It is however observed that if a reference application is filed before the Chancellor, within three weeks from today, it is expected that an expeditious consideration shall be accorded to the same and decision would be taken after giving opportunity of hearing to the parties concerned, preferably, within a period of next three months.
