Heard learned counsel for the parties.
The petitioner has questioned the advertisement dated 1st December, 2018 issued by the respondent for selection and appointment of Assistant Teachers in Junior Basic Schools run by Basic Education Board.
The argument advanced on behalf of the petitioner is that as per the advertisement the cut-off date is July, 2018 whereas according to Rule-6 of the U.P. Basic Education (Teachers) Services Rules, 1981 it should have been 1st July following the year of the advertisement. As far as the argument of the learned counsel for the petitioner regarding the cut-off date is concerned, it carries substance but the question is whether the petitioner can be granted relief or not in this matter. The petitioner's date of birth is admittedly as 2nd May, 1978 and, therefore, he has already attained the age of 40 years on 1st May, 2018.
Under the circumstances, even in case if the cut-off date as has come in the advertisement, is modified and amended as 1st July of the following year, the petitioner would be beyond the prescribed maximum age.
The writ petition lacks merit and is, accordingly, dismissed.
