Heard learned counsel for the petitioner, Sri Ankit Pandey, learned counsel appearing for the complainant and learned Additional Government Advocate. Gone through the writ petition.
The present writ petition has been filed with the prayer for quashing First Information Report relating to case crime no. 536-A of 2010 under Sections 143, 384 & 504 IPC of Police Station Kotwali Nagar, district Gonda.
We have gone through the contents of the First Information Report. Since the allegations made in the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
The writ petition is accordingly dismissed.
However it is provided that if the petitioner surrenders before the court below and moves application for bail, his bail application shall be heard and disposed of expeditiously by the Courts below.
