Heard Sri Brij Raj Singh, learned counsel for the applicants, Sri Arun Kumar Singh, learned counsel for the State and perused the record.
In the present application relief has been sought to quash the impugned order dated 14.09.2006 passed by Chief Judicial Magistrate, Ghazipur in misc. application no. 234/XII/06 Akhilesh Rai Vs. Subhash Chandra Rai whereby the learned Chief Judicial Magistrate in exercise of his power under section 156(3) Cr.P.C. directed the S.H.O. concerned to register and investigate the case.
In the said matter on 05.10.2006 the following order was passed which reads as under:-
"List after decision in Bunch matter relating to cases u/s 156(3), Cr.P.C. leading case being Writ Petition No. 9295 of 2006."
In the aforesaid matter, there is no interim order operating in favour of the applicant. The learned counsel for the applicants has made a statement before this Court that the present application has rendered infructuous.
This Court without going into the issue with regard to maintainability of the present proceeding is dismissing the present application as infructuous.
