1. Notice on behalf of respondent no. 1 has been accepted by Mr. Attreya Tripthi, Advocate, Ms. Samidha, Advocate has accepted notice on behalf of respondent no. 2, whereas notices on behalf of respondent nos. 3, 4, 5 and 6 have been accepted by the office of learned Chief Standing Counsel.
2. This writ petition has been filed, seeking following reliefs:-
i. Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the opp. Parties to pay the compensation of structure (cemented house and shops) constructed over the land situated at village Baitikala, pargana Chanda, Tahsil Lambhuwa, District Sultanpur to the petitioner,which is recorded in the name of the petitioner in the revenue record,which has been acquired by the Government for construction of the N.H. 56 Varanasi to Sultanpur.
ii. Any other order.......... in favour of the petitioners.
iii. Allow the .......... of the petitioners."
3. It is the case of the petitioner that his land was acquired; survey report was submitted, however, surveyor has wrongly shown structure and shop having been constructed over land bearing Gata No. 99, whereas it has been constructed over the land of the petitioner i.e. Gata No.1217 Kha; compensation has not been given to the petitioner for the structure raised on his aforesaid land.

Be that as it may, it is for the Authority concerned to look into the matter and, find out as to whether the structure in question is constructed on plot bearing Gata No. 99 or on plot bearing Gata No. 1217 Kha. The matter is remanded to respondent no. 5-Sub-Divisional Magistrate, Tahsil Lambhua, District Sultanpur to do the needful.
5. With the said observations, this writ petition stands disposed of.
