It appears that petitioner was terminated from service on 3.11.1995, against which he approached the U.P. Public Services Tribunal in Petition No.1148 of 2000, which was allowed on 19.10.2006. A direction was issued for petitioner's reinstatement and to grant him all service benefit, as were extended to his juniors. The salary of the petitioner, however, was not fixed by extending benefits, which were being made available to petitioner's junior and, therefore, petitioner represented in the matter. This representation was rejected on 18.5.2007. Against this order, petitioner preferred Claim Petition No. 737 of 2008, which was also allowed on 29.11.2011. The order dated 18.5.2007 was quashed and a direction was issued to grant all service benefits, as were extended to petitioner's junior.
The grievance of the petitioner is that despite such order of the Tribunal, which has attained finality, he has not been granted benefit for the payment of salary and other service benefits.
Submission is that once petitioner was reinstated, he was entitled to continuity of service with all consequential benefits, as was extended to the juniors. Grievance of the petitioner, in that regard, is stated to have remained pending before the Senior Superintendent of Police, Saharanpur, hence this petition.
Learned Standing Counsel, on the other hand, submits that the grievance of the petitioner shall be examined by the authority concerned, in accordance with law.
Considering the above, this petition stands disposed of with a direction upon the respondent no. 2, to accord consideration to the petitioner's claim, noticed above, keeping in view the order passed by the Tribunal dated 29.11.2011, within a period of three months from the date of presentation of certified copy of this order.
