No grounds exist to transfer O.S.No.636/2010 from the file of the court of the Principal Subordinate Judge of Thiruvananthapuram to the court of the II Additional Subordinate Judge of Thiruvananthapuram where LAR.No.700/2008 is pending. Firstly the recording of evidence in LAR.No.700/2008 has already commenced. Secondly the finding on reference under Section 30 of the Land Acquisition Act, 1894 is itself a declaration of title. Thirdly respondents 2, 3 and 4 are not parties to the Land Acquisition Reference. 2. The question whether LAR.No.700/2008 and error of jurisdiction in the order impugned warranting interference.
The Original Petition is dismissed.
