On perusal of the order sheet, it is seen that since the earlier counsel reported no instructions from the appellants, Court notice was directed to be served on the appellants. Accordingly, Court notice was served on the appellants. After service of the notice, the appeal has been listed today. When the matter was taken up for hearing at 11.15 a.m., there was no representation for the appellants. However, it was passed over and at about 12.15 p.m., when the matter was taken up for hearing, again there was no representation for them. In such circumstances, this Court has no other option except to dismiss the second appeal for non-prosecution.
2. Accordingly, the second appeal is dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petition is closed.
