JUDGMENT / ORDER

Petitioners are accused Nos. 2, 4 and 1 respectively in Crime No.382 of 2014 of the Airoor Police Station for the offences punishable under Sections 143, 148, 342, 323, 365, 506(ii) r/w Section 149 of the Indian Penal Code, apprehend arrest and have filed this application.
2. Learned Public Prosecutor has opposed the application. It is submitted that these accused along with others abducted the de facto complainant and demanded ransom. Accused 1 and 2 entered into criminal conspiracy while the 3rd accused assaulted the de facto complainant. It is also submitted that the 2nd accused is involved in three other crimes.
3. Learned counsel has requested for bail.
4. In the nature of the allegations, the appropriate course is to surrender before the investigating officer and seek for regular bail in the Court concerned.
Application is disposed as under:
(i) Petitioners shall surrender before the officer investigating Crime No.382 of 2014 of the Airoor Police Station on 26.06.2014 at 10 a.m for interrogation.

(ii) In case interrogation is not completed that day, it is open to the officer concerned to direct presence of the petitioners on other day/days and time as may be specified by him which the petitioners shall comply.
(iii) In case arrest of the petitioners is recorded, they shall be produced before the jurisdictional magistrate the same day where, it is open to the petitioners to move application for regular bail with intimation given to the Assistant Public Prosecutor concerned at least two working days in advance.
(iv) If for any reason custody of the petitioners is required, the investigating officer can move application for that purpose before the learned magistrate.
(v) Learned magistrate shall dispose of the application (s) having regard to all relevant circumstances including whether custody of the petitioners is required for any purpose and pass appropriate orders as early as possible.
