Heard Sri Parvesh Kumar Pandey, learned counsel for the petitioners and learned Standing Counsel for respondents No.1 and 2. Notice need not be issued to respondents No.3 and 4 at this stage.
This writ petition has been filed with the following prayer:
"issue a writ order or direction in the nature of mandamus commanding and directing the learned Collector, Ghazipur, District Ghazipur to decide the Case No.00113 of 2021 (Computer Case No.D202114290000113 (Subash Chauhan and others vs. Ramkewal and others) filed by the petitioners under section 128 of the U.P.Revenue Code-2006 for cancellation of the proposal of agricultural allotment dated 15.07.2018 and allotment approval dated 26.10.2018, related to arazi no. 125 area 0.051 hectare situate at village Jafarpur, Pargana Shadiabad, Tehsil Jakhaniya, District Ghazipur, expeditiously within certain stipulated of time as fixed by this Hon'ble Court."
It is contended that proceedings under Section 128 of U.P. Revenue Code, 2006 were initiated for cancellation of Patta granted in favour of the private respondents. The sole prayer is for early disposed of the aforesaid case.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no. 2 to decide the aforesaid case, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
