Petition filed under Section 438 of Cr.P.C. 2. Petitioners are accused in Crime No.988 of 2014 of Ramamangalam Police station. It is alleged they trespassed into the property of the defacto complaint, threatened and assaulted her and outraged her modesty.
3. Heard. There has been a property dispute between the parties concerned. The facts of the case disclosed that this is essentially an assault case. It is doubtful whether Sec.354(B) is attracted. So I am inclined to grant the prayer of the petitioners.
In the result this application is allowed.
(i) The petitioners shall be released on bail after interrogation on their executing bond for Rs.25,000/- (Rupees twenty five thousand only) each with two solvent sureties each for the like sum if they are arrested by the Police in connection with this case.
(ii) The petitioners shall appear before the Bail Appl. No.8932 of 2014 2 investigating officer if they are so required by him in writing.
(iii) The petitioners shall not get themselves involved in any other criminal case while they are on bail.
(iv) If the petitioners violates any of the above conditions, the Court of enquiry/trial is empowered to cancel the bail in accordance with the law.
