The applicant has filed this application for disbursement of Rs.3.62 Crores realized from the sale of the assets and properties of the company under liquidation. It is pointed out by Mr.B.H.Bhagat, learned counsel for the applicant that as far as the property situated at Dholka is concerned, the applicant has first charge over it and the properties have fetched Rs.3.06 Crores. Mr.Bhagat, further pointed out that other properties of Rs.55.40 Lacs wherein the present petitioner is not concerned.
In response to the notice issued by this Court, the Official Liquidator has filed a report dated 31.10.2012. Even though, it appears from the record of the present application, the official liquidator has contended that the claim raised by the applicant as well as respondent no.2, needs to be verified through Chartered Accountant, including the claim of the workers and creditors, if any, of the respondent company.
Considering the said fact, Official Liquidator is permitted to avail service of the Chartered Accountant from the panel of the Chartered Accountants for verification of the claim raised by the applicant, all the workers and creditors. Official Liquidator shall submit his report, after verification is done, latest by 11.01.2013. S.O to 16.01.2013.
