Heard learned counsel for the petitioner, learned Standing Counsel and Sri V.K. Birla for the contesting respondent.
This petition is directed against the Notification under Section 4 of the Land Acquisition Act dated 24.12.2008 issued invoking Section 17(4) of the Act also.
The very same Notification was under Challenge in writ petition no. 65200 of 2009 Smt. Santosh Singh & others vs. State of U.P. & others . A Division Bench of this Court vide reasoned judgment dated 1.12.2009 has dismissed the said writ petition as pre-mature without deciding any point on merit and with liberty to the petitioner to raise all grounds, in case any Notification under Section 6 of the Act is issued.
It is urged that despite the aforesaid decision the petitioners can challenge the notification on various grounds.
Having considered the arguments, the Court is not inclined to take a different view.
For the reasons given in the judgment of the Division Bench in the case of Smt. Santosh Singh & others (Supra), the Court declines to interfere. The writ petition is dismissed with the same liberty.
