S.Thirumalaiselvan vs The District Superintendent Of ...

Madras High Court|06 February, 2017

JUDGMENT / ORDER

The prayer made in the writ petition is to issue a Writ of Mandamus forbearing the respondents 1 and 2 from in anyway interfering with the civil dispute of the petitioner and thereby not to harass the petitioner or his family members under the guise of second enquiry or otherwise.
2. Today, when the matter came up for hearing, the second respondent is present before this Court. A status report has also been filed by respondents 1 and 2 through the learned Special Government Pleader.
3. In the status report filed by respondents 1 and 2, it has been categorically stated as follows:
The petitioner was called for enquiry and the writ petitioner appeared before the Inspector of Police, All Women Police Station, Mamallapuram on 30.01.2017 and given a written statement stating that he got married with the third respondent and some family disputes, his wife gave a complaint before the All Women Police Station and hence, I appeared for enquiry. Further, he stated that he had filed a petition for restitution of conjugal rights before the Sub Court, Chengalpattu in H.M.O.P.No.37 of 2016 and he would settle his dispute before the said court. Hence, there was no harassment or compulsion on the part of this respondent and the allegation in the petition is false and unfounded.
4. In view of the above, no further order is necessary in this petition. Hence, recording the status report filed by the respondents 1 and 2, this writ petition is closed. No costs. Consequently, connected Miscellaneous Petition is also closed.
