3.The claimant in MCOP.No.101 of 2012 also suffered fractures in the skull. He was an inpatient for more than two weeks. The compensation payable to him therefore is reworked as under :
Transportation charges : Rs.10,000/-
Medical Expenses : Rs.45,000/- Pain and sufferings : Rs.54,000/-
Disability compensation : Rs.1,56,000/-
(52x3000) -------------------- Total : Rs.3,00,000/- --------------------
4.The compensation payable to the claimants in MCOP.Nos.100 & 101 of 2012 is enhanced as indicated above. The award dated 01.09.2014 made in MCOP.Nos.100 & 101 of 2012 on the file of the Motor Accidents Claims Tribunal, Principal Subordinate Court, Tirunelveli is accordingly modified.
5.The second respondent insurance company in both the appeals is directed to deposit the entire compensation amount to the claimants in MCOP.Nos.100 & 101 of 2012, with interest at the rate of 7.5% per annum from the date petition till the date of realization and costs, within a period of eight weeks from the date of receipt of a copy of this order, less the amount already deposited if any. On such deposit, the claimants in both the appeals are permitted to withdraw the same, by filing proper application before the Tribunal, less the amount already withdrawn by them, if any.
5.These Civil Miscellaneous Appeals are partly allowed. No costs.
