----------------------- Petitioners claims to be the owners and in possession of 23.75 cents of property in Sy.Nos.235/27m 235/28 and 235/29 in Kunnathidavaka Village, Vythiri Taluk in Wayanad District. Petitioners submits that the above property is erroneously classified as 'Nilam' in the draft data bank. The above property is reclaimed more than 30 years back and it is not suitable for any agricultural purposes. Petitioner's case is that the Local Level Monitoring Committee without conducting site inspection classified this property as ‘Nilam’ in the draft data bank. Petitioners have filed an application before the 2nd respondent to exclude their property from the draft data bank as per Ext.P7.
2. Considering the factual situation, there shall be a direction to the Local Level Monitoring Committee to conduct a site inspection to find out whether this property can be treated as paddy land before the enactment of Kerala Conservation of Paddy W.P.(C).No.29670 of 2014

Land and Wet Land Act, 2008. If the property cannot be classified as paddy land, the respondents shall effect corresponding changes in draft data bank according to the nature of land.
Needful shall be done within a period of four weeks from the date of receipt of a copy of this judgment after conducting a site inspection in the presence of petitioners.
The writ petition is disposed of as above.
