THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.18133 of 2014 Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) In our considered view the relief claimed in the Writ Petition cannot be granted, as we notice that the entire quantity of 13950 Metric Tonnes of coal, as asserted by the writ petitioner has been attached by a valid subsisting order of attachment dated 13.12.2013. In fact, the aforesaid order of attachment has been communicated to the petitioner. But no challenge has been made to the same.
In this circumstance, we dismiss the Writ Petition. However, it would be open to the petitioner to take steps in accordance with law, as may be advised. There shall be no order as to costs.
Consequently, the miscellaneous petitions, if any pending, shall stand closed.
